These Terms of Service ("Terms") govern your access to and use of the website operated by 9 Fold Group LLC ("9 Fold," "we," "us," "our") (the "Site"). By accessing or using the Site, you agree to these Terms.

2) Scope
These Terms apply to Site visitors and anyone submitting information through the Site.
If you purchase or engage services from 9 Fold (including growth marketing, media, analytics, experimentation, creative, engineering, advisory, or related services), those services are governed by a separate written agreement (e.g., Master Services Agreement and/or Statement of Work). If there is a conflict between these Terms and a signed client agreement, the signed client agreement controls.
3) Use of the Site
You agree not to:
- Use the Site in violation of any law or regulation;
- Attempt unauthorized access to systems or accounts;
- Interfere with, disrupt, or harm the Site or its security;
- Scrape, crawl, or harvest data from the Site without our written permission.
4) Informational Content Only
The Site may include general information about our services and approach. It is not legal, financial, tax, or other professional advice.
5) No Guarantees
Marketing performance depends on factors outside our control (platform changes, market conditions, creative response, budgets, offers, competition, and more). We do not guarantee any particular outcome or metric (including ROAS, CAC, revenue, rankings, conversion rates, or profitability) unless expressly stated in a signed agreement.
6) Intellectual Property
A. Site content.
The Site and its content (text, graphics, logos, design, and other materials) are owned by or licensed to 9 Fold and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Site content without our written permission.
B. Client deliverables.
Unless otherwise stated in a signed agreement, the purchaser owns the final deliverables after full payment.
C. 9 Fold background IP.
We retain all rights to our pre-existing and independently developed know-how, processes, frameworks, templates, checklists, playbooks, methodologies, code libraries, tools, and systems (whether or not used in delivering work).
7) Third-Party Platforms
The Site and/or our services may involve third-party tools and platforms (e.g., analytics tools, ad platforms, CRMs). Third parties control their own terms, policies, enforcement, and uptime. We are not responsible for third-party outages, policy changes, account restrictions, algorithm shifts, or related impacts.
8) Confidentiality
If you share confidential information with us through the Site or during early discussions, we will use reasonable care to protect it. Additional confidentiality obligations are typically set out in a signed client agreement.
9) Disclaimer of Warranties
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, 9 FOLD WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
IF WE ARE FOUND LIABLE FOR ANY CLAIM RELATED TO THE SITE, OUR TOTAL LIABILITY WILL NOT EXCEED $100 OR THE AMOUNT YOU PAID US FOR SITE ACCESS IN THE PRIOR 12 MONTHS (WHICHEVER IS GREATER).
(Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.)
11) Indemnification
You agree to indemnify and hold harmless 9 Fold from claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Site, your violation of these Terms, or your infringement of any rights of another party.
12) Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising from these Terms or the Site will be brought in state or federal courts located in California.
13) Changes
We may update these Terms from time to time. Updates will be posted on the Site with a revised Effective Date. Continued use of the Site after changes means you accept the updated Terms.
